Default Fighting a speeding ticket

I've gotten a speeding ticket a couple months ago and I've already pleaded not guilty. My courtdate is coming up and I had to do some research.

I've taken a look at this but I think it's too late to request a "trial by mail." And by delaying the courtdate, doesn't that just give the cop more overtime pay by coming in everytime?

Here's my situation. I've gotten on the freeway, made my way to the "fast" lane, there are 3 other cars in front of me. I'm moving along with these cars at around 75-80 and surprisingly, a cop pulls me over. Writes me a speeding ticket at 84 and accuses me for tailgating, forcing the driver in front of me to go fast. He stated that I'm suppose to stay 3 car lengths behind and that hes been following me for about a good 5 miles.

Here's what I pulled out of

California Drivers Handbook 2004

Pg. 22 - “When you drive much slower than other traffic, do not drive in the “fast” lane. Move to the right when another driver is close behind you...”

Pg. 35 - “ Leave enough space between you and the vehicle ahead for safe stops.”

Pg. 43 - “Three Second Rule”

Pg. 61-62 - “No matter what the speed limit sign may say your speed may depend on: The number, and speed of other cars on the road.”

I've also talked to a traffic school customer service employee, although it was kind of confusing... but doesn't he state that yes you can go faster than normal speed to pass slow traffic as long as your moving along traffic?

Andy: that on the passing lane
Bryan: ok
Andy: as long as your moving along with the traffic
Andy: on that lane
Andy: it would be fine
Bryan: but don't drive faster than the posted speed limit
Bryan: every fine?
Bryan: did we help?
Andy: i mean "okay"
Andy: to drive along with traffic
Andy: at a faster than normal speed to pass slower vehicles
Andy: right?
Bryan: yes
Andy: alright, thank you.

I know i wasn't tailgating and i was just moving along with traffic or else the person in front of me would of changed lanes to let me, the faster traffic, to pass.

could i win this case? haha... man....

Here's my opinion: the tix won't be expensive enough to justify getting an attorney.

Get a short haircut, leave the haircare products at home, shave any facial hair, put on a conservative suit and tie. Half windsor, natch. Go with a mouth full of humble pie.

Then get there early and accept whatever plea bargain they offer. I'm thining this will cost you about $200, with court fees, tops.

I think you are kidding yourself if you think you can walk in and talk your way outta the tix whether it was fair or not.

I hate theese situations ... I have two pending speeding tickets but theese were clocked using radar(don't have to good of a chance). however i beat one in the past because he only paced me I felt that the pacing wasn't accurate, my ticket was like 220$ for doing 85 in a 55? long story short they reduced my ticket to a 150$ donation to a charity of my choice, no ticket on my record and it was tax deductable! very cool!

good luck, man. Last sunday...my roomate was taking over on a long drive. From LA to Bay Area in CA. 50 miles before we're home, my roomate was really starting to love the M Power...too much in fact that we were pulled over. Cop got us at 111 mph and he really gonna get hit hard. 2 points and license probation for sure. There's no way he's gonna try to fight it, so I wish you good luck. Fun cars...but lots of trouble.

First off were you given just one ticket? What are the officers notes on it and what specific State/local statute did he write on there that you violated?

Look up the exact wording of that statute since that is what he has to prove you guilty of in court.

I've beaten of 7 of 10 tickets(over the course of 3 years or so, 4 tix were in the last 6 months so I havnt been convicted in over a year and a half). 3 where the cop didnt show, one where they didnt provide me everything i asked for in a discovery request, 3 where I fought it and won. The tables are skewed in their favor by far but it doesnt mean you can't win. If I wasnt studying biochemistry I'd be a lawyer

Bare minimum just show up hoping the officer isn't there. Immediate dismissal. If he is there and you dont want to fight it then speak to the prosecuting attorney about changing your plea to no contest.

My ticket basically says "22349(a)v/c - speed infraction"

There aren't any extra notes on it. How did you win for the "one where they didnt provide me everything i asked for in a discovery request," what's a discovery request?

You were speeding jackass. Just pay the ****ing ticket and shut-up!!!

By the way, you are not allowed to go over the speed limit even to pass another vehicle (speed limits are the MAX speed that you can go in Normal Driving Conditions, they are not Minimum Speeds).

lol. everyone always complains about societies lack of personal responsibility, but when it comes down to it and it will hurt the wallet, everyone always wants to 'get out of it'.
