Question E46 Subframe Class Action Settlement Expiration

As most of you are aware, in October of 2010 E46 owners will no longer be eligible to receive a free sub-frame inspection from BMW NA. I recently had my car checked out and everything looked good, but what happens if 1-2 years down the road, I notice cracks; will BMW NA still cover the repair?

It's not explicitly stated on http://www.e46subframeclassactionsettlement.com/, and my assumption is that getting BMW to repair anyone's sub-frame beyond that date isn't part of the "settlement." Hope someone can prove me wrong...

didnt know that glad mine got done and might i say there are areas other than the subframe to crack ,spring perches ,wheel wells ....i had tiny cracks all over that area ,was very upset but they replaced my entire rear end when i say entire i mean they did a great job ...complete wheel well,trunk,area that holds the battery ,both sides ,under the back seat .

I believe that was part of BMW's requirement (main sticking point) to the settlement. Pretty much after Oct 2010, BMW is off the hook for this CA settlement.

You could exclude yourself from the settlement and have your own representation and bring a new case to BMW if you want coverage beyond the boundary of this CA settlement.

IIRC, the expiration is 10/2010 OR one year from the expiration of your factory warranty or CPO warranty, whichever occurs LAST.

Interesting, this makes the idea of reinforcing the subframe much more appealing...

According to the official website,

Pretty much. This is what the FAQ has to say:

16. Is there a deadline for me to bring my vehicle in for inspection?

If you own or lease a Class Vehicle with an expired New Car, Certified Pre-Owned or BMW
Extended Warranty, you have one year from the effective date of the settlement to bring your car
into a BMW Center for inspection. If you own or lease a Class Vehicle that has a non-expired
New Car, Certified Pre-Owned or BMW Extended Warranty, you have one year from the
expiration of your warranty to bring your car in to a BMW Center for inspection.

there is no downside to doing this, might as well pay out of pocket and have a reputable shop snap photos for BMW reimbursement

has anyone paid out of pocket to get a sub-frame reinforcement and tried to claim reimbursement by BMW NA? Seems the class action law suit is very unclear that if you did have subframe work done that they would reimburse only what they want to reimburse IF you had it done outside of a BMW certified shop ... so you can take it to any reputable shop to get it fixed if you had a crack? ...

anyone with modded car get reimbursed for fixing subframe crack?

I have an 01 M3 that i bought used a year ago, warranty is obviously long gone, but does anyone know if im still eligible for the inspection/repair? I never recieved anything in the mail about it so im not sure...
