Default Drivers airbag recall

So hers my situation. Found the perfect car I have been looking for all summer. Color I want, one owner, great maintained, etc. Holdup is bmw dealer in Ohio refuses to deliver car with outstanding drivers airbag recall. It is very difficult to figure out the eta and such online because their are so many airbag recalls out there. Best I can see the recall has been out since may of 2015 and bmw still doesn't have a fix. I put a deposit on the car but they can't tell me anything on how long this is going to take. If I'm reading correctly it's already been over a year.

There are no state or federal laws that require a dealer to address a recall before selling a used vehicle.

There are laws that require dealers to fix recalls on new vehicles.

Dealers don't even have to disclose recalls when selling a used vehicle.

Correct, although my local Audi dealer won't sell any of their used cars with the airbag recall.

Found this on Google:
Federal law prohibits auto dealers from selling NEW vehicles that are under a federal safety recall, but there is no similar federal law that specifically prohibits dealers from selling USED cars that have the same defects, and are under the same safety recall.

Doesn't matter, BMW NA won't let the dealer take on that kind of liability. Had the same issue on an X5 I found a while back although now they have a temporary fix for those or limited quantities. If you look up the info online you'll see BMW NA is even offering financial support for dealers due to this issue.


If you really want the car you likely have two options. Wait it out, or see if you can arrange for the dealer to wholesale the car to some used car dealer nearby and finish the transaction with them. If you have a friend with a dealer license that's the route I'd pursue. Just an idea.

Noticed that when running the carfax on my 03 last week as well. It says, "Manufacturer Safety Recall Issued: Driver's front air bag. Status: Remedy Not Yet Available".

Bought an Acura earlier this year from an non-Acura dealer. The car was under the recall and like BMW, Acura won't let it's dealers sell the recalled cars.

I went in for an oil change at the Acura dealer and they told me Acura will cover a similar rental car until the airbag is fixed. I'm happy to rack up a lot of Summer miles on a free rental.

I just checked my VIN on the BMW USA website and it said there was a remedy available.

It also said this:

Your BMW center will replace the driver's front air bag module. Final owner notification letters will initially be issued via US First Class Mail to owners of the highest risk registered vehicles, i.e., oldest models in highest absolute humidity areas (e.g., USA Gulf states). As parts supply increases, all owners of affected vehicles will be notified by First Class mail.

I would say now is a good time to put the deposit down and put lots of pressure on them to get it done. Driver's side airbags are just starting to be delivered (co-worker with 2008 X5 got it installed today) and BMW has three tiers of replacement necessity. Because of the age of our cars, regardless of location, the E46 is first tier which was estimated to start replacements in August this year. I think second tier is December...or maybe early next year, and then third tier is sometime in 2017. There was some information in another post here or elsewhere, but I couldn't find it again on a quick search.

I put a deposit on the car today. It's almost like bmw is reimbursing them for their inventory costs because they surely don't seem to have a sense of urgency about the situation

I got my passenger side done, but they said they're doing easy coast dealers first then west coast dealers.

So I can take my car in and get a free rental?
