Default Failed CA smog due to "OBD Communication Failure"

Like the title says, my 97 M3/4/5 didn't pass the CA smog check because it failed the MIL/Check Engine Light Test due to OBD Communication Failure (though it passed the emissions test). This is the first smog check required for the car since I bought it 2 years ago. I tried using aftermarket OBDII scan tools (Innova) before and I've always gotten communication error codes (though my Peake R5/FCX works fine).

There's power to the OBDII socket. I checked the 4 wires behind the socket and they look fine with good connections. The cap for the round BMW diagnostic socket under the hood is tight (read somewhere that that might cause the communication error). Also read somewhere that it might be a problem with the pins not connecting between the OBDII socket and the OBDII scan tools, but I wired each pin from the the tool to the socket individually just to be sure and still the error.

I've read a bunch of threads regarding this issue on the various BMW forums, but no real solutions besides the tests I mentioned. Before I bring it to the dealership, does anyone have any other suggestions as to what I can do? When the dealership does the smog check, do they use the OBDII plug under the dash or the BMW one under the hood?

Any help would be greatly appreciated.

There is a Service Bulliten to have DME programed!

This is actually fairly common. You'll need to get your ECU updated.

Sorry if this has been discussed to death, but could someone give me the service bulletin number?

And no this car has been smogged before, just not by me.
