What lengths are you willing to go to?

Do your research!
So If I end up get a airbox, how much PITA when you need to pass smog?

In CA, you need no CEL to be on. You need emissions related monitors to be ready except EVAP, which is allowed to be in-op. You then need a tech who doesn't do a visual or does such a poor visual that they don't care/catch that you're intake manifold is not stock, missing MAF, etc and, if you've aftermarket headers/cats, that your cats aren't OE.

The first two are easy enough as they can be done with coding, or, if your car is well maintained and stock, the drive cycles should be met through everyday driving.

The last one is the harder one, but few SMOG techs a) know e46 M3s terribly well and b) are the sharpest tools in the shed or c) don't care or d) may ask for additional compensation - though I can't speak to that as it's not happened to me.

Worst case scenario, you reverse the airbox install and go back to stock once every 2 years - it's not that bad, only a couple hours of work.

Thanks appreciated! I do have Euro headers and cats right now on my car. Everything is OEM.

So you already "technically" aren't smog legal now. Might as well get the airbox then

Your Euro headers/cats being OE have nothing to do with SMOG. You're going to have to find a tech that doesn't know/care that the cats are supposed to be in the headers whether you have euro headers, super sprint, AP, whatever.

I've smogged my car twice since getting the euro headers/sect 1 and the tech didn't even look at all either time. I'm hoping he doesn't notice the massive CF airbox this time

The one good thing, I guess, about CA being so populated and SMOG being a big deal here is that there are a million smog stations in any decently sized city, so you'll find one that isn't a goody-two-shoes at some point.

Don't pre pay! Let them tell you it passed or they won't proceed before talking $ as some will charge you, not pass you, then hold on to some or all of the $ and tell you to come back.
