Lots of good and interesting opinions! 1M would be amazing which was mentioned but thats about twice the budget here...I normally don't have the time, and certainly don't have the technical know how to do anything beyond very basic maintenance, so I would be willing to give up some 'driveability' in return for fewer nagging issues.

I hear you with the 2 E36s, with my E36 and E46 I was always chasing something and right when one got fixed the other would have an issue, usually something minor but it was always annoying.

I may go to a carmax like place in the spring and try to test drive a bunch of stuff and how things feel.

I recently drove a 540i on the track at a BMW event and it's not a car I would buy since I am into performance. Not a bad car, but more of a mid performance luxury car. We have had an 08 535xit for 7 years so I wont knock the 5 series -- they have their purpose. My wife drives it. The wagon and AWD are practical. I put a JB4 on it so it moves a little better. I am about an hour up the road from Boston if the OP wants to drive a lightly modded 08 E90M3 with 6MT or 08 E61 535xit with auto. But it seems to me he is looking more for a less than 5 year old car that is maybe under extended warranty and should not need any work anytime soon -- at that age and price point he probably needs to focus on a lower end 3 series or maybe a subaru.

Damn. Cant believe you guys all missed it. The answer is always... wait for it... GTI.

Fun. Fast (enough). Practical. 6mt available. Great seats. 30+ mpg. Plenty of commute tech. Tunable. New, under 30k all in. Lots to be said for hopping in and not worryng about it.

My GTI was an incredible car. I just sold it because I didn't need a car therefore could get something impractical (the e36 m3)

+1, my DD is a 17 GTI Sport - I can't believe how good it is. Avg 32mpg (mostly a highway / work car), pretty quick. Very fun car to drive...and cheap. Look up what a APR stage 1 tune does - its crazy from a 2.0 4cyl. I wanted something that got decent MPG, manual, <30k (I paid 25k) and that I didnt care too much about leaving in a parking garage or outside for work as I travel all over the midwest.
