For years I did pass with an AA cone intake (came with the car), every year the SMOG guy would say he should have failed me but he let me slide. Then one year, he said he couldn't pass me. I'm pretty sure they get secret shoppers ensuring they follow the rules, so he might have had some issues recently when I was getting my car SMOGed. Ended up putting a stock airbox in, which is probably better than what I was using before anyway.

If you're using OEM parts though, they might let the car pass simply because they're being nice or are ignorant and don't know it's not a CARB approved part.
