no. You don't need the other tubing if you aren't running the flap. It is basically a cold air feed for when the flap is closed.

I would see if your current CSL based software works with your state's emissions testing first. Like I said earlier. I have passed AZ based SMOG (OBDII compliance) twice with no issues and a CSL ECU.

I'd get a VANOS test done. Your VANOS can be slow to react and not throw any codes. I also have troubleshot through this issue chasing the hesitation.

yes I know the hose clamps don't interfere. I am going to remove them to fully clean them this weekend. We will see if that resolves the issue. If not, it will probably mean another new actuator.

You dont need the air shut off valve either. You can just cut the nylon hose off or your stock one, and use vacuum line, or fuel injection line, to plumb in the check valve to the fitting that goes...
